Parents sue after boy loses part of foot to tractor

The parents of a 5-year-old boy are suing a tractor manufacturer after the boy lost part of his foot to a lawn mower.

According to the suit -- filed Monday in Cook County Circuit Court -- Kubota Tractor is liable for the accident involving a Kubota Land and Garden Tractor and Kubota Rotary Mower that left Evan Green's right foot partially amputated.

On May 28, Evan was visiting his maternal grandparents Mr. and Mrs. E.L. Simmons at their home at 21 Settlers Lane in Oswego. According to the lawsuit, about 1 p.m., Mr. Simmons was operating the tractor/mower when, due to a flaw in its design, it amputated part of Evan's foot.

The youths parents, Chad and Amber Green, filed the four-count suit, claiming product liability and negligence on behalf of Evan, a minor, and on their own behalf, as protected in the "Family Expense Act."
