Yorkville men charged with ammo tampering

October 29, 2009

YORKVILLE -- Two men have been charged, including one who was injured, after a September mishap with a bullet, police said.

John P. Bender, 19, of the 8000 block of Highpoint Road, and Nicholas Nitzsche, 19, of the 2000 block of Deerpoint Lane, each face one count of reckless conduct. Bender also is charged with illegally possession of ammunition without a Firearm Owners Identification Card.

Both men surrendered to Kendall County sheriff's deputies on Monday and are free on $2,500 bail.

According to police, deputies were called to Bender's neighborhood on Sept. 15 on a report of a man being shot. They found Bender to have been injured by a .22-caliber round that had "detonated," police said. Investigators later learned the pair had been tampering with the ammunition, causing injuries to both men.

Police were not available to provide additional details Wednesday afternoon. Bender and Nitzsche are scheduled to appear in court on Nov. 13.
